Dear USCF,
 
This letter accompanies a tournament rating report for the 45th GEM CITY OPEN played April 25-27, 2003.
 
In that report you will find 150 games to be rated.  It is this director’s opinion one of the games should not be rated as it was not truly a game. 
 
This is the game between GM Wojtkiewicz (white) and GM Kreiman (black) in round 5. It went as follows.

And a draw was agreed to.
 
The Official Rules of Chess within rule 14.b.6 states, “It is unethical and unsporting to agree to a draw before a serious contest has begun.”  Clearly this draw was agreed to before a serious contest had begun.
 
As a result of rule 14.b.6 I would like your assurances the above game will not be rated.
